All information contained on the website https://www.poterie-ravel.com/en/ (hereinafter referred to as the Site) is in French. However, customers have the option to choose a different version of the store and catalog presentation in English.
The customer acknowledges having, prior to placing an order, become aware of all the aforementioned information and the general terms and conditions of sale.
Before ordering the product, the customer declares that the acquisition of said product is not directly related to his professional activity, as their acquisition is intended for personal use only. As a consumer, the customer therefore has specific rights, which would be compromised if the products acquired through the online store were actually related to his professional activity. Furthermore, he declares having the legal capacity to commit under these general terms and conditions.
2. PURPOSE
These general terms and conditions of sale aim to define the rights and obligations of the parties in the context of a distance sale of goods offered in this electronic store by POTERIE RAVEL.
3. MINIMUM ORDER
The distance selling covered by the general conditions below concerns orders with a minimum amount of 80€ including tax.
We will not be able to fulfill orders below this amount.
4. SCOPE OF THE OFFER
The geographical coverage area of the offer from Poterie Ravel store is as follows: Mainland France.
5. CONTRACTUAL DOCUMENTS
The present contract is formed, in descending order of legal value, by the following documents:
- The general conditions of sale
- The purchase order
The photographs illustrating the products on the website are not part of the contractual scope. If errors or alterations resulting from the processing of these photographs have been introduced, the responsibility of Poterie Ravel can in no case be engaged on this account.
6. ORDER PLACEMENT
Any order form signed with the validation click constitutes an irrevocable commitment by the customer, which can only be challenged in the cases specifically provided for in this contract in the articles "Right of Withdrawal" and "Execution of the Order".
7. ORDER CONFIRMATION
The contract will only be concluded at the time of order confirmation by Poterie Ravel. The customer will receive by mail or email an acknowledgment of receipt confirming the order with all the elements of the contract (ordered products, price, delivery times, shipping costs...)
Poterie RAVEL reserves the right not to confirm an order for any reason, particularly related either to a problem with product supply or to an issue concerning the received order.
8. DURATION OF THE OFFER
The offers contained in this site are valid as long as the products related to them remain online and until stocks are exhausted.
9. PRICES - INVOICE
Prices are expressed in Euros. The price set at the time of purchase is firm and final.
POTERIE RAVEL may change its prices at any time but commits to billing products based on the rates in effect at the time the order is recorded, subject to availability on that date and its actual payment. Any change in the applicable Value Added Tax rate may be reflected in the sale price of the products in the catalog. An invoice will be issued by Poterie RAVEL. The customer must specify the invoice’s mailing address.
10. PAYMENT
Full payment is due at the time of order. The customer agrees to pay the stipulated price for the product ordered on the website. The customer can pay for their order:
• by credit card as offered on the website.
The customer guarantees to Poterie RAVEL that they have the necessary authorizations to use the credit card payment method when placing the order.
• Either by check made out to Poterie RAVEL
If the check is not received within 10 days of the order confirmation by Poterie RAVEL, or if the check is rejected by the bank, Poterie RAVEL reserves the right to cancel the order.
• Or by bank transfer to the account of Poterie RAVEL.
If the transfer is not received within 10 days of the order confirmation by Poterie RAVEL, Poterie RAVEL reserves the right to cancel the order. Bank details are provided at the time of the order.
11. DEFAULT OF PAYMENT - RETENTION OF TITLE
The products ordered remain the property of Poterie RAVEL until full and final payment of their price in accordance with the terms of the law No. 80 335 of May 12, 1980. Poterie RAVEL reserves the right to claim the ordered products in case of non-payment. In this case and upon first request from Poterie RAVEL, the customer agrees to return any unpaid product, with all costs borne by them.
Transaction control
Once payment is validated by the banking center, the order becomes effective. A confirmation email of the order will be sent to the customer upon payment validation.
In case of bank refusal, Poterie Ravel will automatically cancel the current order and the client will be notified by email.
Poterie Ravel reserves the right to cancel an order in case of dispute over the payment of a previous order or suspicion of credit card fraud, or for any other legal reason.
Poterie Ravel may, in the case of an order exceeding a certain amount, request information by email from the Client (copy of ID, proof of residence, etc.). These documents are only requested to ensure that the Client is the author of the order.
It is the Client's responsibility to save and print their payment certificate if they wish to keep their banking details and related transaction information.
Security
The website poterie-ravel.com uses a security system and has adopted the 3DSecure encryption process implemented by Le CIC to protect all sensitive data related to payment methods as effectively as possible.
12. TRANSFER OF RISKS
The transfer of risks to the customer occurs as soon as the products are delivered by Poterie RAVEL to the carrier. The products travel at the customer's risk and peril. The same applies in the case of sending or returning products carried out carriage paid. During the withdrawal period, the customer is responsible for the item as its guardian. In the event of deterioration or destruction of the product while in the customer's care, the customer will bear all the consequences.
13. ORDER EXECUTION
Each order is prepared on demand. Our delivery times will be communicated to you when your order is confirmed by Poterie RAVEL. Delivery will occur within an average of 15 days following the confirmation of the order, subject to the availability of the ordered product and unless a specific agreement between the parties. In case of stock shortage or unavailability of the ordered product, Poterie RAVEL commits to inform the customer as soon as possible and to specify a timeline for availability. The customer will confirm by email their choice either to wait for the product availability or to receive a refund.
14. DELIVERY
As soon as your order is received, it is processed as quickly as possible.
The delivery geographic area corresponds to the coverage area of the offer, namely Mainland France. Products are delivered exclusively to Mainland France. For any requests outside of France (Corsica, overseas territories or abroad), the order will be subject to negotiation between the buyer and Poterie RAVEL.
The information provided by the buyer when placing the order commits them. In case of error or incomplete information in the recipient's address details, POTERIE RAVEL cannot be held responsible for the inability to deliver within the indicated delivery times. Products are delivered to the address specified by the customer on the order form, subject to accessibility. If the address is inaccessible to the carrier, charges will be billed for a second delivery. The products, packaged on pallet(s), are deposited on the roadway (doorstep for villas and building entrance for apartments). Given their size, it is advisable to arrange help for unpacking. The carrier is not authorized to unpack and install the products.
In case of a specific delivery requirement (to a floor, mountain location, restricted access, pedestrian street, crane truck, etc.), an additional cost will be charged to the buyer.
The carrier does not commit to a fixed schedule. The pots are shipped wrapped, on shrink-wrapped pallets, and are transported by the carrier.
Delivery is deemed complete once the product is handed over to the carrier. The delivery slip issued by the carrier, dated and signed by the client upon delivery of the product, will serve as proof of transport and delivery.
Upon delivery, the client must check the contents, conformity, and condition of the product(s). In case of delays, damages, total or partial losses, or any other issue, it is the client's responsibility to pursue all claims with the carrier without ever implicating the responsibility of Poterie RAVEL. Therefore, at the time of delivery, Poterie RAVEL recommends that the client inspect the condition of the delivered products before signing the delivery receipt.
If anomalies are observed, the client must refuse the delivery of the products or issue handwritten, precise, and dated reservations. These reservations must be confirmed with the carrier by registered letter with acknowledgement of receipt within three (3) working days following the delivery of the products. A copy should be sent to Poterie RAVEL.
Deliveries are made from Monday to Friday, excluding public holidays (no delivery on Saturdays and Sundays).
15. WITHDRAWAL OF PRODUCTS IN THE EVENT OF THE CLIENT'S ABSENCE
If the recipient is absent at the time of delivery, the carrier will leave a notice of passage at the delivery address indicated by the client. The buyer must contact the carrier again to arrange a new appointment, according to the terms indicated by the carrier. If the products are not retrieved within the time limits set by the carrier, the products will be returned to Poterie RAVEL, which reserves the right to refund the price of the products, with the shipping costs remaining the responsibility of the client.
16. CLAIMS
As our pots are entirely handmade, sponge marks, roughness, and fingerprints cannot be considered as defects but are an integral part of the pottery. The weights, capacities, and dimensions are approximate.
In case of an error with the product, claims for non-conformity of the product(s) delivered with the order must be made in writing directly to Poterie RAVEL and immediately upon receipt. The customer must keep the packaging and the delivery slip.
In case of an error with the product, the customer agrees to return the said product or the products concerned within 7 days following their receipt to Poterie RAVEL, provided that they are returned unopened, in their original condition and packaging with the accompanying documents. Upon receipt of the product in proper form, Poterie RAVEL will resend, at its expense, the product originally ordered.
17. RIGHT OF WITHDRAWAL
The customer has a period of 14 working days from the delivery of their order to return, at their own expense, any products that are not satisfactory for an exchange or refund, in accordance with Article L 121-16 of the Consumer Code. If this period expires on a Saturday, Sunday, or a public holiday, it is extended until the next working day.
The returned product must be in its original condition and packaging. It must not have been used, nor have suffered any deterioration, however minor, and must be in a perfectly clean state. This right of withdrawal is exercised without penalty. Within a maximum of 14 days from the receipt of the product, the customer will be refunded the amounts paid. To this end, they will provide Poterie RAVEL with their bank details.
The pots being handmade, the traces of sponge, roughness or scratches are not defects but are an integral part of the poterie.
Notification of withdrawal:
Before returning any product, the Customer must notify their intention to withdraw by sending back the withdrawal form duly completed and signed to the following address:

Product return conditions by the Customer in case of non-conformity or exercise of the right of withdrawal:
In accordance with the provisions of Article L 121-21-3 of the Consumer Code, the Customer must return their product no later than fourteen days after communicating their decision to withdraw.
The Client must return their product to the following address:

The costs of returning products are the responsibility of the Customer.
The transportation of the returned products is the responsibility of the Customer.
The cost for the product return by the Customer will depend on the carrier the Customer chooses to return their product.
The Client's refund will be made by any means of payment within fourteen days from the receipt by Poterie Ravel of the request to exercise the right of withdrawal by the Client, if the concerned product has been received by Poterie Ravel within this period.
However, in accordance with paragraph 2 of article L 121-21-4 of the consumer code, this reimbursement period is deferred until the product is recovered by Poterie Ravel.
The return of all ordered products will result in a refund equal to the total amount paid by the customer, that is, the purchase price of the product(s) bought and any possible delivery charges (excluding return costs).
To fully benefit from the Right of Withdrawal conditions, the Customer must return the product to Poterie Ravel, 8 Avenue des Goums, 13400 Aubagne.
In order to simplify and facilitate the processing of product returns and any potential refunds, it is strongly advised that Customers follow the procedure described below:
• the products must be properly protected, in their original packaging, in perfect resale condition (not damaged, impaired, or soiled, unopened and still sealed) along with any potential accessories, instruction manuals, and documentation.
• accompanied by the sales invoice so as to enable the latter to identify the customer (order number, first name, last name, address).
• without the product having been obviously used, meaning that it must not show signs of use beyond the time needed for testing and must be in a condition that allows for its resale.
If the Client chooses a return method other than the one described above, it is essential that Poterie Ravel can identify the Client making the return in order to proceed with the refund. Therefore, it is necessary to include with your returned product any documents that allow us to identify you (a copy of your order summary or a copy of the invoice).
Any item returned damaged and/or not in its original packaging and/or without all of its accessories will not be eligible for a refund. A depreciation fee will subsequently be charged to the customer if the item has been handled in ways other than those necessary to establish its nature, characteristics, and proper functioning.
18. WARRANTY
The products sold are covered by the legal warranty against hidden defects provided by articles 1641 and following of the Civil Code. To implement the warranty, the customer must return the product to Poterie RAVEL at their own expense, including the original invoice. The product will be exchanged for an identical product and sent to the client at the expense of Poterie RAVEL, unless there is a stock outage or the product is discontinued from the range offered by Poterie RAVEL. In this last case, Poterie RAVEL will proceed with the refund of the product price to the customer.
Warranty Exclusions
Products that have been modified, repaired, integrated, or added by the Client or any other person not authorized by the supplier of said product or service are excluded from warranty. The warranty will not cover apparent defects. The warranty will not cover products damaged during transport or due to improper use.
19. PERSONAL INFORMATION
The automated processing of information, including the management of users' email addresses, has been declared to the CNIL and registered under number 1589863. It is carried out in accordance with the provisions of Law No. 78-17 of January 6, 1978. The personal information requested from the client is essential for processing and delivering orders, issuing invoices, and potentially guarantee contracts. For these purposes, this information may be communicated to the contractual partners of Poterie RAVEL.
The client may object to such communication and, in accordance with the "Information Technology and Liberties" law (Law of January 6, 1978), has the right to access, modify, correct, and delete data concerning them by contacting Poterie RAVEL, 8 avenue des Goums, 13400 Aubagne, tel 04 42 82 42 00, fax 04 42 82 42 01. For reasons of fraud limitation, Poterie RAVEL may request proof (of identity, residence, etc.). We thank you for your understanding.
20. ELECTRONIC SIGNATURE
The "validation click" constitutes an electronic signature.
This electronic signature has the same value as a handwritten signature between the parties.
21. PROOF
The computerized records, kept in the computer systems of Poterie RAVEL under reasonable security conditions, will be considered as proof of communication, orders, and payments made between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as evidence.
22. INTELLECTUAL PROPERTY
Poterie RAVEL holds the intellectual property rights to the website and the right to distribute the elements featured in the electronic store catalog, including photographs. Consequently, partial or complete reproduction, on any medium, of the elements that make up the site and the catalog, their use, and their provision to third parties are strictly prohibited.
23. ENTIRE AGREEMENT
These general terms and conditions of sale express the entirety of the obligations of the parties. No other general or specific conditions communicated by the client can be integrated or deviate from these general conditions.
24. NO WAIVER
The fact that Poterie RAVEL does not take advantage of a breach by the client of any of its obligations should not be interpreted as a waiver of the concerned obligation and to assert this breach at a later time.
25. NULLITY
If one or more provisions of these general conditions are held to be invalid or declared as such pursuant to a law, a regulation, or following a final decision of a competent jurisdiction, the other provisions shall retain their full force and scope.
26. DISPUTE
This contract is subject to French law, both for substantive and procedural rules. IN CASE OF DISPUTE AND IN THE ABSENCE OF AN AMICABLE AGREEMENT BETWEEN THE PARTIES, EXPRESS JURISDICTION IS ATTRIBUTED TO THE COURTS WITHIN THE JURISDICTION OF THE HEAD OFFICE OF POTERIE RAVEL.
